1 § Definitions

  1. Service Provider - Webkameleon Sp. z o.o. with its registered office at ul. Kazimierza Odnowiciela 23, 62-010 Pobiedziska, TaxID: PL7811831916, registered by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS number 0000322785.

  2. The service - access to the Application that allows you to manage (the construction and upgrade) Internet service provided by the Service Provider under the terms of these Regulations, in accordance with the specifications set out on the website of the Service Provider.

  3. Client - the entity commissioned by the Service Provider and bearing the costs of its provision.

  4. The application [webkameleon] - Client software sharing in SAAS model, ie on the customer's computer via a web browser, accessible via HTTP or HTTPS after login using the login and password.

  5. Customer Account - Application configured and available for the customer, according to the parameters specified by the client, ie (template website, number of websites, websites providing users)

  6. User - the customer, an employee of the Customer or a person acting on behalf of the Customer with access to the Client Application Services.

  7. Fee - fees paid by Customer for the Service provided, in accordance with the tariff and specifications posted on the website of the Service Provider.

  8. Agreement - the agreement of the Service Provider and the Customer under which the Service Provider is required to provide services and the customer to pay fees in accordance with the tariff and specifications posted on the website of the Service Provider.

  9. Suspension of Benefits Services - blocking access to the accounts for users.

  10. Cessation Benefits Services - the complete removal of the Customer Account Application.

 

2 § Terms of Service

  1. The customer is the owner of all data entered into the customer's account.

  2. The service provider is required to adequately provide services for which the client requests fee.

  3. The Service Provider is not responsible for the disruption in the Service caused by:

    1. malfunctioning Internet Browser Client

    2. malfunctioning Internet connection,

    3. acts of third parties,

    4. due to reasons beyond the control of the Service Provider.

  4. The Service Provider is not responsible for the consequences caused by the disclosure of the Customer's Account password to third parties.

  5. The Service Provider reserves the right to Discontinue or Suspend Benefits Services and block access to the account in the event of:

  6. breach by you of these Rules,

  7. use accounts in a manner inconsistent with applicable law,

  8. nonpayment by the Customer invoice or pro forma invoice issued by the Service Provider.

  9. Service Provider reserves the right to Suspend Benefits Services and block access to the account in the event of nonpayment by the Customer invoice or pro forma invoice issued by the Service Provider. In the case of institutional clients, after locking the account referred to, the Service Provider reserves the right to charge a penalty for unlocking the account in the amount of 50% of the unpaid invoice.

  10. Service Provider reserves the right to terminate the Agreement, Cessation Benefits Services and to remove the unpaid customer accounts after the free trial period of 30 days.

3 § Complaints

  1. The customer can file a claim for non-performance or improper performance of service, application malfunction or the amount of the invoice.

  2. Complaints must be submitted in writing in the form of a letter sent to the address of the Service Provider or by e-mail addressed to the address editor@webkameleon.com sent from the account, which the complaint relates.

  3. Complaint concerning malfunction popowinna indicate Account Application, User, time and description of the circumstances of the problem. In the event of an error message to be transmitted its exact content. The complaint should be filed immediately after wsytąpieniu problem.

  4. Complaints will be dealt with within 14 days from the date of notification.

4 § Final Provisions

  1. Regulations come into force on the date of publication on the website of the Service Provider.

  2. The right of ownership and copyrights to the web application chameleon are the exclusive property of the Service Provider.

  3. In matters not governed by these rules shall be governed by the Civil Code and relevant laws.

  4. Ordering Service Customer declares that accepts the present rules.

  5. The customer agrees to receive commercial information about the products and services of the Service Provider. Consent may be revoked at any time by issuing an appropriate statement by the Client.

  6. Service Provider reserves the right to change the rules. Any changes are effective from the time make a new version of the Regulation on the websites of the Service Provider.
